MEMORANDUM OF DECISION ON DEFENDANTS' MOTION TO DISMISS

This action represents a collateral challenge by plaintiff Jackeline Mathias Aguiar of the removal of her father, Nicercio Jose Procopio, from the United States. This action is for declaratory judgment and injunctive relief to stop the removal of plaintiffs father. Now pending before the Court is the defendants' Motion to Dismiss (Doc. # 17).
