MEMORANDUM OPINION

COLLEEN KOLLAR KOTELLY, District Judge.

This matter is before the Court on defendant's Motion to Dismiss. For the reasons discussed below, the Court will grant defendant's motion and will dismiss this action with prejudice.

I. BACKGROUND

Plaintiff alleges that "[h]e was a U.S. Navy serviceman ... from 1973 to 1977[.]" Compl. ¶ 2. He states that he was found guilty by a special court-martial of two violations...
