I. INTRODUCTION

Plaintiff James Wheeler ("plaintiff) brings this action against defendants Sandy Parker ("Parker"), Bruce Potter ("Potter"), and Berkshire Union Free School District ("District") (collectively "defendants") for denial of due process of law under the Fourteenth Amendment to the United States Constitution and 42 U.S.C. § 1983.
