Appellee State of Arkansas petitioned this court for review of the court of appeals' unpublished opinion in which that court denied the State's cross-appeal of Appellant Darra Barritt's conviction of battery in the first degree. See Barritt v. State, 2007 WL 2713593 (Ark.Ct.App., 2007). The court of appeals affirmed Barritt's judgment of conviction on direct appeal, leaving only the cross-appeal by the State for our review.
