The defendant was indicted on four counts of rape of a child by force in violation of G. L. c. 265, § 22A, two of which (counts 3 and 4) were based on a theory of joint venture. The defendant was found guilty on one of the indictments (count 1), but on the remaining three (counts 2-4), he was convicted of the lesser included offense of statutory rape.
