Summary judgment was properly granted to plaintiff on the Labor Law § 240 (1) claim in this action where plaintiff suffered injuries when, in the course of unloading sheetrock from the hoist that had been used to deliver the material to the 37th floor of the building under construction, the hoist suddenly dropped down the shaft, thereby causing him to fall approximately 13 stories.
