Michael Sale was convicted of the murder of his wife, Lynn Sale, made capital because it occurred during the course of kidnapping in the first degree, a violation of § 13A-5-41(1), Ala.Code 1975. After the penalty phase of Sale's trial, the jury unanimously recommended that he be sentenced to death. The trial court then ordered a presentence report.
