BUI v. BERMAN

48 A.D.3d 287 (2008)

851 N.Y.S.2d 175

TRINITY BUI, Respondent, v. NEIL BERMAN Appellant.

Appellate Division of the Supreme Court of the State of New York, First Department.

Decided February 14, 2008.

Defendant's motion to dismiss for lack of personal jurisdiction was properly denied in this action where plaintiff seeks repayment of a loan. Although a Florida resident, defendant transacted business within the state when, while in New York, he negotiated the subject loan agreement with plaintiff (CPLR 302 [a] [1]; Ivens Stanton Assoc. v Nor-Quest Resources, 195 A.D.2d 314 [1993]).
