SIMMONS v. STATE

No. 28451.

247 S.W.3d 86 (2008)

Robert SIMMONS, Movant-Appellant, v. STATE of Missouri, Respondent-Respondent.

Missouri Court of Appeals, Southern District, Division Two.

March 10, 2008.

Attorney(s) appearing for the Case

Mark A. Grothoff, for Appellant.

Jeremiah W. (Jay) Nixon, Atty Gen, and Jamie Pamela Rasmussen, Assistant Attorney General, for Respondent.

DON E. BURRELL, Judge.

This appeal stems from a denial of Robert Simmons' (Movant) Rule 29.151 motion for post-conviction relief. In his single point on appeal, Movant alleges his trial counsel was ineffective for failing to investigate and call certain witnesses because he believed their testimony would have resulted in a different outcome in his criminal trial.
