Defendant is charged with three counts of aggravated harassment in the second degree (Penal Law § 240.30 [1] [a], [b]). He moves, inter alia, for an order dismissing one count of Penal Law § 240.30 (1) (a) and one count of section 240.30 (1) (b) for facial insufficiency.
