Vesta Construction and Design, L.L.C., ("Vesta"), appeals the dismissal of its negligent misrepresentation claim against Michael Howe, an employee of Lotspeich & Associates, Inc., ("Lotspeich"), based upon Howe's alleged negligence in supplying information to Vesta while performing a contract between Vesta and Lotspeich.
