PEOPLE v. HOPKINS

No. 1-07-0224.

889 N.E.2d 1149 (2008)

The PEOPLE of the State of Illinois, Plaintiff-Appellee, v. Ralph HOPKINS, Defendant-Appellant.

Appellate Court of Illinois, First District, First Division.

May 27, 2008.

Attorney(s) appearing for the Case

Michael J. Pelletier, Deputy Defender, and Douglas R. Hoff, Assistant Appellate Defender, Office of the State Appellate Defender, Chicago, for Appellant.

Richard A. Devine, State's Attorney of Cook County, Chicago (James F. Fitzgerald, Peter Fischer, and Clare Wesolik Connolly, Assistant State's Attorneys, of counsel), for Appellee.

Presiding Justice CAHILL delivered the opinion of the court:

We are asked to decide whether a statement, made by a codefendant or witness and used to induce an illegally detained suspect to confess, can support attenuation absent a finding that the statement was legally obtained. Our appellate courts have addressed this issue indirectly and reached different results. Compare People v. Klimawicze, 352 Ill.App.3d 13
