THIS CAUSE comes before the Court on Defendant's Motion to Dismiss [DE 42] filed on March 19, 2008. After I dismissed Plaintiffs claims in my order dated February 13, 2008 [DE 36], Plaintiff filed an Amended Complaint [DE 40]. Having considered the Motion to Dismiss,* Response, and Reply, I grant the Motion to Dismiss and now dismiss this case...
