This matter is before the Court on Plaintiff Western Power Sports, Inc.'s ("Western Power") motion for partial summary judgment and Defendant United States Customs and Border Protection's ("Customs") cross-motion for partial summary judgment. For the reasons that follow, the Court grants Customs' cross-motion for partial summary judgment.
