The basic issues before the court are: whether plaintiff has shown a mental condition that would entitle her to the tolling provisions of CPLR 208 based on insanity; whether the longer limitation periods provided in Administrative Code of the City of New York (the Code) §§ 8-904 and 10-404 are preempted by the provisions of the CPLR; and, if not, whether this action is viable under said sections.
