Before the court is Swift Transportation Co., Inc.'s ("Swift") motion to exclude the testimony of Terry and Donna Fredericks' ("Fredericks") expert, Art Atkinson (Docs. 212, 213). A response has been filed and the matter is ripe for decision. (Doc. 234). A Daubert hearing was held on November 3, 2008.
