The State filed a bill of information, charging the defendant-appellant with first degree murder in violation of La. R.S. 14:30 on May 15, 2003. The defendant was arraigned and pled not guilty. A twelve-person jury found the defendant guilty as charged. The jury was deadlocked as to the penalty to be imposed.
