Before the Court is defendant's motion to dismiss or for summary judgment (Doc. 17), to which plaintiff responded (Doc. 19).1 Defendant seeks dismissal of plaintiffs complaint on the grounds that the Federal Tort Claims Act (FTCA), 28 U.S.C. § 2671-2680, bars plaintiffs claims.
