GRUENDEL, J.

The petitioner, James Davis, appeals from the judgment of the habeas court dismissing his petition for a writ of habeas corpus. He claims that the court improperly concluded that res judicata barred relitigation of his claim of ineffective assistance of trial counsel in preserving his appellate rights.1 We affirm the judgment of the habeas court.
