Earl R. Cleghorn petitioned this Court for the writ of certiorari after the Court of Civil Appeals reversed the decision of the trial court, which had modified a previous custody order and awarded Cleghorn custody of Cleghorn and Tina M. Bledsoe's minor daughter. We granted certiorari review to determine whether the Court of Civil Appeals' decision conflicts with our decision in Ex parte McLendon, 455 So.2d 863
