In a single order, the district court granted defendant John Randall Futch's ("Futch") 28 U.S.C. § 2255 motion as to his 240-month sentence and remanded for resentencing but denied his § 2255 motion as to his conviction claims. After a resentencing hearing, the district court imposed a new 215-month sentence for Futch's convictions for conspiracy to possess with intent to distribute, and to distribute, cocaine, in violation of 21 U.S...
