Before the court are four pretrial motions filed by defendant, Nicholas D. Groos ("Groos"): (1) a motion to dismiss insufficient indictment; (2) a motion to dismiss counts 2 and 4 for failure to state an offense; (3) a motion to strike surplusage; and (4) a motion for depositions of foreign witnesses.1
