Roy Anthony Johnson ("Johnson") was charged by an indictment issued by a St. Bernard Parish grand jury with second degree murder in violation of La. R.S. 14:30.1. The grand jury "returned a `true bill'" on November 28, 2001. The indictment was signed on November 29, 2001.

After a sanity hearing held on January 15, 2002, the trial court determined that Johnson was unable to adequately assist in his defense and remanded him...
