MEMORANDUM AND ORDER

Pending before the Court is Defendant City of Houston's ("City") Motion to Dismiss [Doc. # 45]. Plaintiffs have responded [Doc. # 47]. Because Plaintiffs requested that the Court consider matters outside of the pleadings in deciding the City's motion, the Court converted the motion to dismiss to a motion for summary judgment and Wilted the City to submit evidence in support of its position.
