This matter comes before the Court on appeal by the United States Trustee ("Trustee") from an order of the bankruptcy court denying as untimely the Trustee's motion to dismiss the underlying bankruptcy case pursuant to 11 U.S.C. § 707(b)(2) and the subsequent order granting the Debtors a discharge.
