I. Introduction

This is an employment discrimination case brought by the Equal Employment Opportunity Commission ("EEOC") on behalf of Juan Obed Perez ("Perez") against BE & K Engineering Company ("BE & K"). BE & K, subsequently, moved for summary judgment1 and this court granted summary judgment in favor of BE & K.
