Jimmie Gaines was tried by jury and convicted of fleeing or attempting to elude a marked police car, possession of cocaine, and habitual driving with a revoked license. Then, despite defense counsel's representation that there was no basis for a downward departure sentence and over the State's objection, relying upon section 921.0026(2)(j), Florida Statutes (2006), the trial judge imposed a sentence that was less than the lowest permissible sentence...
