MEMORANDUM OPINION

I. INTRODUCTION

Plaintiff Harry T. Collins, a former inmate at the Howard R. Young Correctional Institution ("HRYCI"), filed this action pursuant to 42 U.S.C. § 1983. He proceeds pro se. Presently before the court are motions for summary judgment filed by the remaining defendants Warden Raphael Williams ("Williams") and Correctional Medical Services, Inc. ("CMS").1
