STATEMENT OF THE CASE

Randy LeBlanc ("LeBlanc") was involved in an automobile accident on August 12, 2004 while in the course and scope of his employment with Boh Brothers Construction Co., L.L.C. ("Boh Brothers"). LeBlanc was traveling eastbound on Interstate 10 when a vehicle driven by Travis Guntenaar crossed the center line and struck LeBlanc's vehicle.
