¶ 1. On June 19, 2001, Dupuis was indicted by a Lincoln County Circuit Grand Jury for sexual battery, in violation of Mississippi Code Annotated Section 97-3-95 (Rev.2006). Dupuis was tried twice-the first trial ended in a mistrial when the jury was unable to reach a verdict.
