In March 2004, claimant, a tenured guidance counselor employed by the New York City Department of Education, was charged with 42 specifications of misconduct for actions she committed during the 2001-2002 and 2002-2003 school years. Following a hearing pursuant to Education Law § 3020-a, at which she was found guilty of 38 specifications of conduct unbecoming her profession, she was terminated from her position and applied for unemployment insurance...
