December 12, 2007.

Attorney(s) appearing for the Case

Markes E. Kirkwood, Law Offices of Markes E. Kirkwood, San Antonio, TX, for Appellant.

Troy L. Meinke, Assistant Criminal District Attorney, San Antonio, TX, for Appellee.

OPINION

Opinion by STEVEN C. HILBIG, Justice.

Kevin Gore seeks a writ of mandamus to compel the trial court to (1) vacate its order abating a civil forfeiture action until several criminal prosecutions are completed and (2) order the State to provide discovery. We hold the trial court abused its discretion by abating the case and therefore conditionally grant the requested writ in part.
