Corporation's ("Banc One") Motion For Summary Judgment (D.I. 115) and Defendant Forest Electric's ("Forest") Motion For Partial Summary Judgment. (D.I. 120). For the reasons discussed, Banc One's Motion will be granted and Forest's Motion will be denied.
