¶ 1 Appellant, Elwood K. Jackson, Jr., was tried by a jury and convicted of three counts of First Degree Murder with Malice Aforethought1 in the District Court of Comanche County, Case No. CF 2003-95. The State filed a Bill of Particulars alleging three aggravating circumstances: (1) the defendant knowingly created a great risk of death to more than one person;
