THE PEOPLE OF THE STATE OF NEW YORK, Respondent, v. EDWARD JAMISON, Appellant.

Appellate Division of the Supreme Court of the State of New York, Second Department.

Decided January 16, 2007.


Ordered that the order is affirmed insofar as appealed from; and it is further,

Ordered that the resentence is affirmed.

The Supreme Court properly denied that branch of the defendant's motion which was to vacate the judgment of conviction pursuant to CPL 440.10.

The resentence imposed was not excessive (see People v Suitte, 90 A.D.2d 80
