Opinion by Justice CARTER.

James Clearnon Ingram was convicted by a jury for selling a controlled substance at a location within 1,000 feet of a playground. Two enhancement convictions were also alleged. Ingram chose to have the trial court assess his punishment— which it set at forty-five years' imprisonment. The evidence shows that Ingram sold six rocks of crack cocaine (less than one gram) to an undercover officer. The question raised is...
