{¶ 1} Defendant-appellant, Randall Asberry, was indicted by a Cuyahoga County Grand Jury in June 2005 on two counts of escape in violation of R.C. 2921.34, a felony of the second degree. The indictment resulted from appellant's failure to timely report to his parole officer.
