COHEN, J.

During the defendant's Superior Court jury trial on charges arising from the armed robbery of a convenience store, the judge found that two of the Commonwealth's witnesses were feigning lack of memory. Over the defendant's objection, the judge admitted, for substantive purposes, excerpts from the witnesses' testimony at the earlier trial of the defendant's alleged coventurer.
