CITY OF SAN ANTONIO v. YTUARTE

No. 05-0991.

229 S.W.3d 318 (2007)

CITY OF SAN ANTONIO, Petitioner, v. Dolores YTUARTE, Respondent.

Supreme Court of Texas.

Rehearing Denied August 24, 2007.

Attorney(s) appearing for the Case

Jack Pasqual, Office of City Attorney, Dan Pozza, San Antonio, for Petitioner.

Cathleen Lockhart, Lockhart Law Firm, P.C., Jeffrey D. Small, Law Office of Jeff Small, San Antonio, for Respondent.

PER CURIAM.

In this interlocutory appeal from an order denying the City of San Antonio's motion for summary judgment, we consider whether the court of appeals sufficiently analyzed the good faith element of immunity in a police pursuit case. Police officers are entitled to immunity for performing discretionary duties within the scope of their authority provided they act in good faith. City of Lancaster v. Chambers, 883 S.W.2d 650
