Ordered that the judgment is reversed, on the facts and in the exercise of discretion, with costs, that branch of the motion pursuant to CPLR 4404 (a) which was to set aside on the ground of excessiveness the jury verdict as to damages for past and future pain and suffering is granted, the order dated May 31, 2006, is modified accordingly, and the matter is remitted to the Supreme Court, Kings County, for a new trial on the issue of damages for past and future pain and suffering...
