OPINION

DAVID WELLINGTON CHEW, Chief Justice.

The State Office of Risk Management ("SORM") appeals the trial court's grant of a no-evidence summary judgment motion in favor of Appellee Hector Escalante. In a sole issue, Appellant argues that there exists a genuine issue of material fact precluding a grant of summary judgment. We affirm.
