OPINION

PRICE, J., delivered the opinion for a unanimous Court.

We granted review in this case to examine whether the Second Court of Appeals erred in deciding that Article 21.25 of the Texas Code of Criminal Procedure was not applicable.1 We conclude the court of appeals did err in its conclusion. Therefore, we reverse the judgment of the court of appeals and remand to the court of appeals for consideration of the appellant...
