¶ 1 Pursuant to a plea agreement, petitioner Cesar Francisco Rubiano was convicted of attempted sexual conduct with a minor, a class three dangerous crime against children. Thereafter, Rubiano sought post-conviction relief pursuant to Rule 32, Ariz. R.Crim. P., 17 A.R.S., raising various claims.
