Kay Watson petitioned the justice of the peace court for a forcible entry and detainer1 to remove Robert M. Geldard, Sr., her stepfather, from the house in which he had lived for about thirty years. In defense, Geldard claimed equitable title and his homestead right to remain in possession of the property. Both the justice court and, on appeal, the county court at law found in Watson's favor...
