LEO v. STATE

No. 4D06-4780.

959 So.2d 1284 (2007)

Philome LEO, Appellant, v. STATE of Florida, Appellee.

District Court of Appeal of Florida, Fourth District.

July 18, 2007.

Attorney(s) appearing for the Case

Philome Leo, Blountstown, pro se.

Bill McCollum, Attorney General, Tallahassee, and Mark J. Hamel, Assistant Attorney General, West Palm Beach, for appellee.

PER CURIAM.

We reverse in part the trial court's summary denial of appellant's motion for postconviction relief. We conclude that several claims of ineffective assistance of counsel were not conclusively refuted and require record attachments or an evidentiary hearing.

First, claims 4, 5, 6, and 7 all stated facially sufficient claims of ineffective assistance for failure to call witnesses. See Nelson v. State, 875 So.2d 579
