This matter comes before us on a "Motion to Dismiss Suspensive Appeal, Alternatively to Convert it to a Devolutive Appeal," filed by the plaintiff-appellee, Lionel Roch.

The plaintiff's motion to dismiss concerns the timing of the 30-day delay for filing a suspensive appeal under La. C.C.P. art 2123. Therefore, the underlying facts of this case are not relevant to this procedural issue.
