These are consolidated appeals in which Boatwright Construction, LLC ("Boatwright"), the plaintiff below, appeals from an order granting Scott R. Tarr's ("Tarr"), motion for judgment on the pleadings and Tarr appeals from an order denying his motion for attorney's fees.1 We affirm, in part, and reverse, in part.

For purposes of this appeal, we must accept all well-pled factual allegations of Boatwright's amended complaint...
