GRANBERRY v. STATE

No. 5D06-3988.

967 So.2d 1044 (2007)

Samuel D. GRANBERRY, Appellant, v. STATE of Florida, Appellee.

District Court of Appeal of Florida, Fifth District.

November 2, 2007.

Attorney(s) appearing for the Case

James S. Purdy, Public Defender, and Henry T. Swann, III, Assistant Public Defender, Daytona Beach, for Appellant.

Bill McCollum, Attorney General, Tallahassee, and Carmen F. Corrente, Assistant Attorney General, Daytona Beach, for Appellee.

MONACO, J.

The sole issue presented by this appeal is whether the trial court erred in giving the forcible felony exclusionary charge described in section 776.041(1), Florida Statutes (2002), as part of the standard self-defense jury instruction. The appellant, Samuel Granberry, argues that because his only defense at trial was "self-defense," the trial court's error in giving a misleading and confusing instruction was fundamental.
