This appeal is a sequel to our decision in Broadnax v. New Haven, 270 Conn. 133, 851 A.2d 1113 (2004) (Broadnax I). In Broadnax I, we considered the legality, under the city of New Haven's charter, municipal ordinances and civil service rules and regulations, of the practice of "underfilling" in the New Haven fire department.1 We concluded that underfilling is not permissible under the city's governing laws...
