Timothy Turner filed a motion pursuant to Florida Rule of Criminal Procedure 3.850 asserting that his trial counsel was ineffective in a number of ways. Judge Susan W. Roberts ordered an evidentiary hearing on all grounds. At the conclusion of the hearing, Judge Roberts did not rule on the motion but asked Turner and the State to submit legal memoranda on the points at issue.
